Turning Towards the Lord

Turning towards the Lord presents an historical and theological argument for the traditional, common direction of liturgical prayer, known as "facing east," and is meant as a contribution to the contemporary debate about the Catholic liturgy. Lang, a member of the London Oratory, studies the direction of liturgical prayer from an historical, theological, and pastoral point of view. At a propitious moment, this book resumes a debate that, despite appearances to the contrary, has never really gone away, not even after the Second Vatican Council. Historical research has made the controversy less partisan, and among the faithful there is an increasing sense of the problems inherent in an arrangement that hardly shows the liturgy to be open to the things that are above and to the world to come. In this situation, Lang's delightfully objective and wholly unpolemical book is a valuable guide. Without claiming to offer major new insights, Lang carefully presents the results of recent research and provides the material necessary for making an informed judgment. It is from such historical evidence that the author elicits the theological answers that he proposes.

WTO and Direct Taxation

  • Categories: Law

WTO Law and Direct Taxation are linked in numerous ways. The WTO Agreements, thereof especially the GATT and GATS Agreements, contain several explicit provisions on the subject of direct taxes or even on its delimitation from Tax Treaty Law. To some extent, the scope of application of WTO Law has been broadened by case law to comprise also direct taxes. This entails overlappings particularly with regard to the law of subsidies, prohibitions of discrimination, and most-favoured-nation obligations. This book highlights increasingly relevant interdependencies between WTO Law and Direct Taxation from the viewpoint of 21 States. Special emphasis is placed on the conformity of national taxes on pr...

Multilateral Tax Treaties

Differing provisions in bilateral tax treaties lead to undesired consequences. Tax administrations expend considerable energy combating tax structures devised by taxpayers and their advisers who attempt to use these differences to their advantage. This battle uselessly engages the resources of both enterprises and tax authorities. A model multilateral tax treaty could provide the solution to this problem. The advantages and disadvantages of multilateral tax treaties have been debated for many years. While some multilateral tax treaties have been concluded at regional levels, the concept has yet to gain wide acceptance. Multilateral Tax Treaties results from a research project conducted at th...

At present, a number of cases regarding the fundamental freedoms in respect to direct taxation are pending at the European Court of Justice. This book shall discuss the national background of the pending cases and a possible infringement of a fundamental freedom by observing the ECJ's testing scheme on the basis of the request for a preliminary ruling and if available of the opinion of the advocate general. The pending cases are all presented by highly recognized experts in the field of European tax law of the country that made the request for the preliminary ruling.
